TERMS & SERVICE AGREEMENT
This General Service Agreement (the “Agreement”) dated the day of purchase, is between the Customer, herein referred to as “Customer” and Jnana Marga Technologies Pvt Ltd, herein referred to as “Service Provider”.
Service Provider has agreed to provide services to the Customer on the terms and conditions set out in this Agreement, while Customer is of the opinion that Service Provider has the proper and necessary qualifications, experience and abilities to provide services to Customer.
Therefore in consideration of the matters described above, the receipt and sufficiency of which consideration is hereby acknowledged, the Customer and the Service Provider agree as follows:
1. The Service
Jnana Marga as the Service Provider is to provide the Customer with one of the following services (the “Services”) provided according to the following payment choices and possibilities
NEET
(A) a Rs 27000 full service for 2 years + Rs 7000 for 3rd year
(B) a Rs 20000 full service for one year + Rs 10000 for second year + Rs 7000 for 3rd year
JEE
(A) a Rs 30000 full service for 2 years + Rs 7000 for 3rd year
(B) a Rs 22000 full service for one year + Rs 12000 for second year + Rs 7000 for 3rd year
2. Term of Agreement
This Agreement will begin on [Beginning Date] and will remain in full force and effect until the completion of the Services. This Agreement may be extended by mutual written agreement of the parties. Extensions will cost additional money as laid out above. There is no refundability clause in the agreement.
3. Service
As part of the service, the students typically receives a tablet(except when it is a lecture based service). The student works with the program offered. The service is to help the student prepare academically for JEE or NEET based on the student’s choice. The student will receive a lecture series as well as help in studying using social media via Jnana Chat.
The service facilitates integrated learning from both eBooks as well as slides.
Additional services like custom lectures are available for extra charge based on the tutor
and his or her pricing.
4. Pricing and Costs
The Customer will provide compensation according to chosen method for the services from the list of services above rendered by the Service Provider as required by this Agreement and specified in 1. Above. Compensation is payable at per the schedule provided typically ahead of the periods specified.
5. Terms regarding the Devices
The Devices are provided by Jnana Marga and the terms of warranty start on the day the student receives the device and continue for 6 months. The warranty is provided by the Device maker, Domo Global. For all hardware or system related failures contact Domo Global. If you contact Jnana Marga, then Jnana Marga will first discern whether it is a system or hardware issue and then request you to correspondingly deal with the situation. If it is a software or service issue, Jnana Marga may require you to down a new App. Under certain circumstances, Jnana Marga may request shipping to Domo.
6. Modification of Agreement
Any modifications or amendments to this Agreement may be required if there are material changes in conditions outside the scope of the seller.
7. No Liability, No guarantee of success
Jnana Marga will look to help the student but there is no guarantee whatsoever. Neither is any liability due from Jnana Marga. The student should aim to inform Jnana Marga after the use of the service of his success or his academic acceptance and choice.
We offer no guarantee of success in the exams NEET and JEE which are extremely competitive exams. The student should look to use our platforms well and rely on any additional coaching to help him or her succeed as they see appropriate.
8. Notice
All notices or demands required or permitted by the terms of this Agreement will be given in writing and delivered to the parties.
9. Time is of the Essence
No extension or variation of this Agreement will operate as a waiver of this provision. Time is of the essence in this Agreement. Extensions can be purchased as discussed in the earlier clause.
10. Integration
This Agreement contains the entire agreement and understanding by and between the Customer and the Service Provider and no representations, promises, agreements or understandings, written or oral, not herein contained shall be of any force or effect.
11. Choice of Law
This Agreement and the performance under this Agreement and all suits and special proceedings under this Agreement, be construed in accordance with and governed by the laws of the Government of India.
12. Severability
The provisions of this Agreement shall be deemed severable, but only when both Jnana Marga and the student mutually agree or there are terms explicitly laid out that allow the lapsing of the agreement, and the invalidity or unenforceability of any one or more of the provisions hereof shall not affect the validity and enforceability of the other provisionshereof.
